I had joined a LTD company 4 Months(m in a probation period) back in New Delhi after quitting a steady job. I have got new opportunity to work with a new brand with good designation and salary package.
At that time I would had been already intimation to the store manager regarding my resignation in a very short period(2-3 days) and I had given my resignation via mail……..
Now after one month the HR of my previous company is called me up and told me that there is some outstanding amount (Internet usage) which you have to pay another they have to issue you a legal notice
Please help me out and temme what to do

The outstanding amount is $10,000, and now she is saying that, "Your notice period is 30 days; hence, you need to serve the notice period. In case the notice period is not served, we will recover one month's salary in lieu of notice."

If the notice period is 30 days, then you have to give 30 days' notice or pay salary for 30 days in lieu of notice.

If internet usage charges are for personal use and the company has a policy of recovering the actual usage charges of the internet, then you have to pay. But how is it that the amount is Rs 10,000 when there are many internet offers providing unlimited use at Rs 750 per month?

In any case, it is always better to resign in person and obtain a relieving order to avoid such problems in the future.

Dear Anoop,

You have violated the terms fixed between you and the organization (please check your appointment letter if there is any clause related to a one-month notice period). If you have not signed any contract, then there is no need to pay 30 days' salary. If you had signed it, then you should pay the 1-month basic + DA (excluding all conveyance/allowances).

Please clarify the internet surfing charges too from your previous organization.

Small family-run companies often indulge in unethical means to harass ex-employees; this fact should be well known by all. These types of companies acquire the title of "company" because of the helpful laws that encourage corporatization. In practice, these companies are worse than even baniya's shops.

It is a case of harassment; especially internet use of Rs. 10,000/-

Please let them file a civil suit against you for recovery, then deal with the case in a lawful way.
