    I need to have a clarification from you on Maternity benefit act. If the female employee is working on contract basis for about last 11 months and she is in probation period will she eligible for maternity benefit under this act?
    If the organisation where she works is non profitable organisation then the provisions of the act apply to the employees or not?.
    Is there any sub sections statying that the act does not apply to the employees of socieites or the non profitable organisations?

    Is the act applys to only the confirmed employees?

    If the employee is eligible for the benefit and the employers refueses what to do?

    Jatinder Pahwa: Dear Sir,

    I would like to introduce my self.
    I am Jatinder Pahwa having qualification of B.Com, MBA and working as Deputy Manager in a chemical industry in Punjab. Due to recession our company stopped production in the m/o Jan 09 and till date they have not started production. The company has three more plants in Haryana and after three months the company has shifted some of their employees in other units on temporarily basis and said you would be on deputation without giving any notice. The employees who were not interested to go there were told either to go on leave or submit their resignation.

    Some of the employees have submitted their resignation after getting a job but the company is asking to give a notice period. Could you please advise whether in this situation the notice period is applied or not.

    Further, the company is making deduction from gross salary on a/c of notice period instead of Basic salary. Kindly advise.
