Please refer to your question, If the company decided to take resignation of an employee with immediate effect and accepting the resignation of the employee. Here the employee is forsefully resigned from is employment and it is required from the company side, so the company is bound to one month notice pay as compensation.

The best practice is to issue show cause notice to employee asking for causes of his low performance....and if he still nt prform well then u can ask him for resignation, with the notice period mentioned in appointment letter, in that notice period he can search a new job for himself as wel as he get the salary or it can be the immidiate effect but with np sal.
but he should get all the relevent documents

it depends on the terms in the appointment letter. but, it will be humanitarian if you can give. bcoz the employee will take at least one month time find a new job. he has to survive for that one month and repay his debts.
