Dear Seniors ,
One of our Senior staff has resigned & joined another company to form similar kind of business set up
After joining our competitive company ,he is luring our other technical staff
t o join him . Also he is approaching our clients/vendors to get business prospects .
Also found one of our technician, without resigning from us , has been working with this particular person & passing some of our confidential information about our business to him for past one week and was caught red handed . Is there any way we can take action against these two people . Waiting for valuable suggestion from seniors before we proceed with legal action .

Dear Asha,
The legal action can be encouraged if the employee is passing the confidentialinformation about your company business to another company which has no approval from higher authority. But you must have such proof which is not orally but may be in written or data sharing through CD or any relative mails from his personal or professional mail-id & etc those can be visible.
The show cause notice can be issued to the employee particularly for those who have not resigned & who have not served the notice period as mentioned in the appointment letter.
But We can't encourage any further proceeding to legal actions on the employee who is trying to take your staff into the company he works.
