Hi, I am interested in knowing:

1) Whether call centers are covered under the labor act or if any provisions are made.

2) If the call center closes without notice, does the employee have the right to file a complaint against the employer?

I also require help on the following issues:

1) If we appoint a candidate and later want to demote them, can the employer do this, including reducing their salary?

2) Is there any provision in labor law regarding demotion by the employer without a specific or satisfactory reason?

Kindly assist me with this.

Dear Bobby,

Yes, BPO is a commercial establishment and the Shops and Establishment Act of the respective State is applicable. In addition to the above, PF, ESI, Bonus, Gratuity, Industrial Disputes Act, and Industrial Employment Standing Orders are also applicable but are subject to coverage which depends on manpower strength and the kind of operation.

Hi,

I want to confirm as I am working in a domestic BPO, our company has not paid anything for Diwali. Earlier, we used to get a bonus or double wage for that day, but this time there was nothing in the salary. Moreover, the company deducted Rs. 250 from everybody's salary for "wear and tear" of the headset as shown in the salary slip under miscellaneous deductions.

Please provide information about the incentives/bonuses for any nationalized holiday if anyone worked on that day. Also, explain the deductions from the salary.
