Can anyone discuss what formalities and statutory requirements need to be complied with in the HR department when a new industry starts, including the time frame for all departments such as Labour, PF, ESI, Fire, Employment Exchange, etc.?

Hi,

As far as PF and ESIC are concerned, one has to keep in mind that the number of employees should be 20. Even if it is less than 20 and the company/organization wants to implement PF and ESIC, it can do so. In that case, it has to apply/register with the Regional Provident Fund Commissioner.

In the case of employment exchanges, whatever vacancies exist in the company, one can advertise them in the exchanges. When it comes to the fire department, precautions need to be taken regarding the lift (renewing the license) and fire safety.

First and foremost, apply for approval of the factory building plans to the Chief Inspector of Factories or to the officer authorized in this behalf of your State. Obtain Fire and Pollution NOC. Apply for a Factory Licence in the prescribed forms as applicable, i.e., in accordance with your State Factory Rules, along with the prescribed licence fees to the CIF of your area. If the BOCW Act, 1996 is also applicable in your State, then apply for registration and deposit cess at the appropriate time.
