Subject-HR Activities
Hi am an MBA graduate passed out in 2010. presently am working in small private Bpo non-voice company as asst.HR Manager since 3.5 months. It is a start up company, and all the HR activities are unorganized.Am the only person in the HR Department, where nobody is there to guide me. Please help me how best i can learn all the HR activities through the internet. Am presently handling the Payroll, Attendance, Recruitment,general office works. Pls help me how the PF,ESI etc are calculated. i don't know that,as we are not paying PF & ESI to our Employees. pls Reply

My appointment letter says:
1. You will be on probation of 6 months from th date of joining during which your services can be terminated by the company without any notice. After completion of probation, your services can be terminated on three month's notice and similarly if u leave the company you have to serve three months notice or pay three month's salary thereof.
Does this mean that during probation, only company can terminate me w/o notice, whereas if I have to leave, I should give them 3 months notice or salary.

Hello abhi2017,
The Appointment letter has been very cleverly drafted.
It is silent reg the Notice period you have to serve during Probation while mentioning clearly from the Comapny's perspective.
In the given situation, Pon is right.
Pl note that the KEY WORDS you can use to your advantage are: ".........and similarly........." which have been mentioned in context to the AFTER PROBATION period.
And since it is silent reg the BEFORE PROBATION period from YOUR perspective, you can use the 'by implication' factor: meaning if the Company can fire you without notice period, you too can do the same DURING PROBATION.
However, suggest take a final advice from a lawyer before taking any firm action.
