Understanding Labor Law Applicability in the IT Industry

When any activity falls within the definitions of "industry" under section 2(j) and "industrial establishment or undertaking" under section 2(ka) as defined in the Industrial Disputes Act, 1947, it generally attracts the provisions of almost all labor laws in force, subject to the basic conditions of their applicability.

IT and ITES establishments are considered part of the industry, although they differ from conventional manufacturing industries and establishments of trade and commerce. Despite their workforce comprising academically qualified and well-paid individuals—referred to by Peter Drucker as "knowledge workers"—in terms of employment laws, they are similar to their blue-collar counterparts in conventional industries. They have rights to legally fixed working hours, weekly holidays, leave, the ability to seek redress against illegal termination, to form trade unions, and similar rights.

Dear Mr. Umakanthan,

Does the IT industry in Tamil Nadu come under the purview of 'The Factories Act' or 'The Shops and Establishment Act'? Although I am an accountant, I raise this question because of some apparent confusion in understanding by some of my IT friends. I would be thankful if you could shed some light on the laws that govern the monthly remuneration in the IT industry, with specific reference to Tamil Nadu.

Hi,

In confirmation and continuation of our learned friend's above reply, I would like to answer the second query of your post. Since the IT industry is covered by the States' Shops and Establishments Act according to its locale, firstly, all other labor laws are applicable to its employees depending upon their employment position/capacity. Secondly, monetary labor legislations such as the Payment of Wages Act, 1936, and the Payment of Bonus Act, 1965, are applicable, subject to the salary limit prescribed in each one.
