Request for Experience Certificate After Termination

I have been terminated by a reputed financial company. Now, I have received an interview call from another top organization, and they are asking for my experience certificates from the previous company. I have emailed my HR several times and also spoken to the Head of the company (below the level of MD). As a permanent staff member of that company, how can I request and obtain an experience certificate? Please assist me as this is urgent. I am in need of the experience certificate.

Background of Termination

Note: I was terminated because I did not follow company policies, despite being a dedicated employee who worked for five years as a permanent staff member. I have learned that some staff members and certain HR officials were involved in my situation, but the company did not accept my request. I provided a written statement against some staff members to the vigilance department during the inquiry, and they verified my claims with the concerned parties, confirming their validity.

Once again, I request you to provide me with the right suggestions for my future.

Legal Recourse for Employees Under the Shops and Commercial Establishments Act

Banks are covered under the Shops and Commercial Establishments Act. Therefore, employees can approach:

- **Lawyer/Law Firm:** A legal notice can help to instill a sense of responsibility. You may request your lawyer to include HR personnel, the Head, appointing authority, CEO, Chairman, and MD in the list of people to whom you must send notices. You can also inform them that you are being victimized since you exposed illegal acts. Designation alone does not decide if an employee is covered as an 'Employee' under the Shops and Commercial Establishments Act, and as a 'Workman' under the ID Act. Consult a lawyer who may ask you a set of structured questions and may opine that you are covered.

- **Trade Unions/Employees Unions:** They know how to handle such issues well.

I do hope you have all your salary slips, resignation letter and acceptance by the company, Form 16, etc. These documents also serve to prove your experience.

Regards
