Dear all,

Today there is news in the newspapers that the gratuity for the state government employees of Andhra Pradesh (A.P.) has been increased to 8 lakhs, exceeding the recommendations of the pay revision commission of 7 lakhs and the demand of union leaders of Rs. 10 lakhs. Are private employees also eligible for this increase?

Dear Aakhyagopal,

State governments and the central government decide the amount of gratuity for their employees, including employees of public sector undertakings. For all other employees in this country except government employees, railway employees, and defense personnel, there is the Payment of Gratuity Act, 1972, as amended from time to time. The latest amendment to this act was dated 25/05/2010, raising the ceiling from Rs. 3.50 lakh to Rs. 10 lakh. The Government of Andhra Pradesh amendment is applicable only to its own employees and employees of public sector undertakings fully owned by it.
