Hi Shalini,
Its good that action has been taken on him. but still ensure that the action should be such that all the employees should get the message that no one will be spared for doing any such activities.
And one more thing we ourself give oppurtunity to bully us. Always be firm and strong and dont let anybody trouble you on the basis of Gender,Caste, Experience or Post.

Make sure if it was a male employee or her manager. Any personal enmity between him/her? Hope they convert the department in to boxing ring with knockout sessions. Anything may happen in the North. I hear this sort of an incident after several years. Hmm... Human Reliability is dwindling now a days. What a pity!

Hi,
I totally disagree from your point this is not the solution for such problem by marrying forcibly with any girl we are putting the girl in jeopardy.
We should first learn to accept and respect ourselves for what we are. and fight by ourselves for any in justice beign done to us.

What is Sex Discrimination at work?
&
Is Employer liable for such Acts caused by his employee’s?

Sexual Harassment / Discrimination is not only a Indiscipline atmosphere in an organisation but also illegal as per law, if the same is reported to the Employer or his authorized representative in writing and even then when no prompt action not taken against such report, the employer stands default and is punishable under the law.

To my knowledge and as studied in some of the law subscriptions let me explain as per the extracts under for public in general knowledge:

This kind of discrimination occurs when a particular group of individuals receive treatment that have a negative bias and can be either direct or indirect. Direct discrimination is when a particular individual treats another disrespectfully purely from the gender perspective and indirect is when at the work place, a particular employer shows negative bias towards people of a specific gender and does not apply the same rules or accord facilities offered to others of a different gender.

Exception

While it is illegal to have any discrimination from the gender perspective, some exceptions are allowed which permits the employment of people of the same sex, as in the case of a nursing home managed by only men or women. Discrimination against a woman due to pregnancy or the fact that she has had to avail of maternity holidays is definitely against law and can be reported.

What is harassment and what is victimization?

One other form of gender harassment is the creation of a working atmosphere that affects the dignity and impinges on the pride of the individual based on gender. Similarly, when an employer accords harsh treatment to somebody who has already complained of such behavior in the past, it can be construed as victimization and can be reported by fellow employees with corroborative evidence.

What is the liability of the employer?

In an organization, if the employer is found to be ineffective in controlling situations of gender bias and unfavorable treatment to specific people, they become liable to provide justifications as to why they allowed it to happen and what action they propose to take to prevent recurrences. The affected individual can approach his immediate line manager and also the Tribunal for justice. Further steps to proceed legally can also be taken depending on the merits of the case. However, it is recommended to settle any issues within the company and take the legal route only if all options fail.

What about sexual harassment?

Though sexual harassment has been prevalent, it was not seriously taken in labour laws, until the year 2005, than noting the illegal aspect on the subject matter, law board had put up its recommendations to add a specific section to the subject matter and it was accepted and was incorporated into the Sexual Discrimination Act and under this Section, any action that violates a person's dignity through unsolicited sexual propositions, vulgar comments, getting subjected to display of pornography and lewd jokes as well as unsolicited comments on the outfit worn all constitute sexual harassment and it is the responsibility of the employer to prevent such instances from occurring at the work place through adequate safeguards and rules. You can also take direct action against such offenders by building up opinion against the offender by confiding in your close friends and your union. Telling the offender to quit such action is also well within your right and you can even give this to him in writing to put it on record.

An employee who dare to harass his co employee, should be taken into task, unitedly by rest of the employees in the organisation, report in writing to the top management, if no action is being taken up by the management, the report can be submitted to the Commissioner of Labour or his subordinates, the case can be booked under the Sexual Discrimination Act. So go ahead to pull such employees out.

Jokes apart - As an HR, please ask him to mind his language. This will not promote any sort of good atmosphere at work otherwise.

Hello Everybody,
What I could suggest is when somebody is asking for a solution, please help him/her by giving a suggestion on over coming such issues rather than commenting on what happened. This would help the person to have a discussed idea of what should be done. Again people who give a suggestion have to think about how that would help the girl in a safer being.
Any actions taken against the boy shouldn't bring down a personal vengeance against the girl. Please do take it forward with all consideration in mind. I am really sorry if this statement of mine would have hurted any one personally... :)

I completely agree with "octavious" that your company which is located at place, where there is no Law and order or democracy."
Do take serious action against him.
Experience doesn’t matter shalini. What matters is Attitude, skill and then knowledge of an individual.
Complain your Manager and make sure illegal actions are taken against him and at the same time protect the girl too.
