Hello Seniors,
I am working in Small IT form,we are now crossing 20 employees.
i want to have a clear understanding on pf,esic rules.
what i know is for pf,esic mim 20 emp is compulsory.
i am planning to introduce pf ,esic here,
pls help .

I just wanted to confirm few things about PF anf esic.
All employees are drawing basic above 6500,we need to deduct Rs 780 for all ???
or ESIC minimum gross should b less than 15000,the ones who are drawing more than 15000 are ot entitled for esic???

Dear Shuba,
Employees drawing salary above Rs.15000/- are not entitled to ESIC and regarding PF, it is not mandatory to enroll the employees whose basic and DA exceeds Rs.6500... It is the option of employees to become the member of PF

Thanks Kumar, But I am confused because in my company total strength of employees is 20 + and all are drawing basic more tha 6500. So if i donot register pf..will it be ok

Dear Shubha
You need to register with EPFO, just that if basic of all employees is more than 6500/- then there will be no contribution but administration charges will be payable every month. When employees are having basic salary more than 6500/-, it becomes optional for the mgt. to contribute or not to contribute. It is voluntary decided by mgt. and staff.
Esic will be applicable only to those who are drawing gross salary less than 15000/-.

is it min.Rs 780 ?? or 1.1% of basic + DA
this administration charges will be payable by employer not employee.
am i right??pls guide

Before going for coverage of your factory/establishment under ESI Act, please confirm from appropriate office of ESIC whether the area where your establishment is located is an implemented area. If so, your factory/establishment will be coverable if employing 10 or more persons for wages and where manufacturing process is carried on.
Under ESI Act, employees getting wages exactly Rs.15,000/- will also be coverable. The employees are not coverable only if they exceed their wages ( excluding the amount of OT) from Rs.15,000/- per month. Hope my these remarks will be of some help to you.

Sir,
EPF Act applies to all those establishments employing 20 or more persons. You may note that 20 employees also includes your security staff, all temporary staff, assistants etc. If all are drawing more than Rs.6500/- there is no need for coverage at present, but has to start paying when any employees are employed for salary less than Rs.6500/-. As regards payment of minimum adm. charges i am of the view that if there are no employees for whom you are going to contribute there is no need for payment of administrative charges. You may inform the concerned Pf office the factual position and may also inform that you will apply for code number once who employ any employee statutorily eligible to contribute to PF.
