Dear Seniors,
I am Narmadha. I am working as a Sr. Executive HR. One of our Company Employee cut the Cable which we have got it from our Client to do some rework. This Employee has taken a bunch of Cables in that & cutted it. Initially we didn't know who had done it. We have done the enquiry on it & caught him. When we asked him he didn't gave any reason for this. The cost of this Cables id around 20 - 22 Lakhs. Kindly suggest me what kind of action the Company can take against him.
There is no HR Manager in our Company & this is a first case in my life with this Situation. Kindly suggest me what kind of action the Company can take against him.

Hi Miss.Narmada,
You can terminate/dismiss him/her from the employment if you have enough material in your hand to prove it because this is very serious misconduct, plus you can also forfeit his/her bonus, gratuity if he/she is eligible.

Thanks for you Suggestion Mr. Kumaran. But if we remove him from Company, tomorrow if he go and file a case against the Company that the Company has removed him without any reason then what would be the solution for this.
Infact, I have given the same solution to our Management & they are asking me this same question. We have got the written statement also from him that he had only done this act. But tomorrow he can claim that by forcingly the Management has got this written statement from him.
So I need someone to guide me that whether any FIR to be lodged against this Employee or can provide any other suggestions.

As the cost of the material is in laks hence better to go for a police complaint so that the similar attitude people will also have a fear in mind. simultaneously you can charge sheet him, organize domestic enquiry and terminate. Some of the companies don't want to go for police complaint then go for charge sheet, domestic enquiry and terminate.

Dear Narmadha,
You must terminate the employee as it is gross misconduct and act against the company. It is very important to keep the proofs ready which proved him guilty about the act.
Even if an employee go to labour court these proof can be useful to protect the rights of employer.

Hello Narmada you can do one thing generate the warning letter against him and send the one copy to his home address and wait for his reply if didn't get back to you again resend the warning letter and if again he is not replying than you have the power to terminate him with immediate Effect.

Please give full details of the case. Is these cables are assets of the company and how it will impact your companies relation with regard to clients/customer and what this employee designated and what is his responsibilities, unless you provide full details, one cannot judge with little details.

Since there is serious material damage to company property-lodge an FIR in Police station under whose jurisdiction the office is situated.
Conduct an in house enquiry with independent members.
If enquiry brings out actionable proof company can terminate his services and also proceeded legally against t employee who has knowingly damaged company property.
Your company will suffer loss as the cable will have to be replaced at own expense.
Is there any specific reason for the employee to have done such an act??
Or is it plain mischief??

Dear Narmada,
first up all you should conduct the inquires related to cut the company cable and strong evidence . same day close gate him/her because he will create the new situation on company behalf.

Dear Mr. Natharao,
Thanks for your suggestion. We have prepared the Domestic Enquiry Report on this issue. he doesnot have any motive behind this activity and lodged Police Complaint also. Police is enquiring him from their side at present. I will update on further process in this Cite. So it may be useful for any HR's for their future perspectives.
