Dear Mr Jadhav. The Shops and establishments act differs from state to state and the leave policies also . Hence please refer the states enactment in which your company is located.

Then go through section 35 (chapter VII) of the Bombay Shops & Establishment Act, 1948 for framing your leave policy.

Can any body explain me the provision of Leave under shop & establishment act.
As per the act Chapter VII Section 35 (1) every employee who has been employed for not less than three month in any year, shall for every 60 days on which he has worked during the year be allowed leave , consective or otherwise, for a period of not more than five days.
Here my question is whether it mandatory on the part of employer to give 5 days leave for every 60 days of work ie (2.5 days of leave per month) or can give leave less than 5days leave as mentioned under the act.

Dear Soundarrajan,
You have given detailed eligibilities of leaves.
But I doubt whether the 12 days of casual leave is mandatory or optional in all the states? Can you please clarify me.
