Please advice how to write final settlement letter for an employee :confused::!:

This is not okay.

PF is not supposed to be in the F & F settlement slip. Deductions must be shown with all details. According to me, this document should be sent by Regd. AD and not through courier.

Thats true.. PF cannot be shown in final settlement letter. Settlement letter should only carry your office related transcations. regds, Reena Banerjee

Dear Rizwan bhai, Please add tax/TDS deduction becuase after full & final settlement,it is more difficult to deduct tax/TDS from the employee side. Best Regards Sajid Ansari

Dear friend,

For full and final settlement, first, you have to demand the management to release your pending salary and expense reimbursement through a registered letter. After 15 days, you have to send a legal notice to the management stating that if they do not release the pending amount, you may file a computation claim petition before the Labour Court under Section 33C(2) of the Industrial Disputes Act, 1947. Definitely, they will release your full and final settlement.

Importance of Employee Acknowledgment for Final Settlement

How important is acknowledgment from the employee who is receiving the final settlement to an employer/organization? Can it be deposited directly into their bank account without obtaining an authorization letter from them, or should the employee collect it in person from the Finance department, or should the cheque/DD be posted through a courier? What is an acceptable norm for releasing final dues to an employee?

Gratuity Payment and Retirement

An employee working in a private organization receives his gratuity after completing 58 years, as per the company procedure and the insurance policy of gratuity to employees. However, he continues to receive regular salary increments, promotions, and EPF recovery as usual up to the age of 70 years. After reaching 70 years, he is retired by issuing an order of retirement. He has been settled with PF and leave encashment but not paid gratuity under the pretext that it was already paid at retirement/superannuation.

Eligibility for Gratuity

The question arises whether he is eligible for gratuity until the date of his retirement, considering that he has been treated as a regular employee throughout. If gratuity is to be paid, how should it be calculated?
