Adding to what Dinesh has said, have you sent a showcase notice to the employee's home address? What action did you take when this employee absconded? Also, he cannot take any action against you as he has absconded, and his plea will not be valid in a court of law.
Company Policy on Uninformed Leave
First, inform him that according to the company policy, if an employee goes on an uninformed leave for more than three business days, they will be considered not interested in continuing their employment with the company and will be removed from the payroll/employee list. Please make these changes in your Handbook with immediate effect.
