Dear Concern,

If an employee leaves the company without giving resignation and serving the notice period, and later requests for the Full and Final settlement after 1 month, even though the employee was voluntarily discontinued by the employer, what should be the next step? The employee is continuously demanding the Full and Final settlement.

When an employee leaves employment without giving proper resignation or completing the notice period, it is called "abandonment of employment." Before striking off the employee's name from the company's rolls, a domestic inquiry needs to be conducted. Depending on the number of days of absence, an appropriate punishment may be given.

In your case, we need a little more information. Please confirm when the employee joined your company, when they left, the terms and conditions of the notice period, whether you have standing orders approved by the labor department, and if any notice was sent to the employee for their absence. Adding to what Dinesh has said, have you sent a showcase notice to the employee's home address? What action did you take when this employee absconded? Also, he cannot take any action against you as he has absconded, and his plea will not be valid in a court of law.

Company Policy on Uninformed Leave

First, inform him that according to the company policy, if an employee goes on an uninformed leave for more than three business days, they will be considered not interested in continuing their employment with the company and will be removed from the payroll/employee list. Please make these changes in your Handbook with immediate effect.
