For the past six years, I have been working with an AICTE-approved private management college as an assistant professor. I am also designated under college code 28 in accordance with the rules and approval of the respective affiliating university. Recently, I tendered my resignation from the college by providing one month's notice as per the terms of my appointment letter.
I have approached the college management requesting payment of gratuity in accordance with the Payment of Gratuity Act. However, the management has declined to release the gratuity amount, claiming that the institution lacks provisions for such payments.
I seek guidance on how and where I can obtain legal assistance regarding this matter.

If the management is not coming forward to pay your gratuity amount, then approach your area Labour Office for intervention in the matter. Make a complaint to the area Labour Inspector/Inspector declared under the Payment of Gratuity Act, 1972. If he fails to resolve the matter, then file a claim case before the Authority under the PG Act.

Please write to the Deputy Commissioner of Labour in your jurisdiction, submitting your claim and requesting their intervention in the matter. The Deputy Commissioner is the competent authority for administering the Gratuity Act. Contacting Labour Inspectors will not assist you in securing your eligible gratuity.
