This is Sushilkumar, trustee of an SFI. Kindly provide me with information regarding termination and resignation.

Termination Due to Absenteeism

If a candidate (who has been working for more than one year) is sick for a week and has submitted a medical certificate, can he/she be terminated for absenteeism?

Contract Renewal and Termination Procedure

Regarding a candidate on probation with experience of more than one year, whose contract ended in December 2012 without a written renewal, and a year has passed since then, can a relieving letter be issued? Is it unlawful to continue working without renewing the contract? What should be the termination procedure in this case?

If the candidate was absent due to sickness and has submitted a medical certificate stating the sickness, how can the employer terminate the candidate for the reason of absenteeism?

Contract Renewal and Termination

If the contract is not renewed but the contract work was ongoing and remuneration was paid, it is deemed as the contract was renewed for the same period. For example, if an amount is deposited as a Fixed Deposit and if the said deposit is not withdrawn on the expiry date or renewed, the FD gets renewed for the same period automatically, in my view.
