We have 13 staff only in our company; we all started working from 2 Feb’2011. We have fixed the salary for Rs5000/- it’s a new company, do we have to deduct PF and ESI for our staffs in the first months salary.

Hello,
As per the law if the employee strength of the company is 20 or more then the PF and Esic is deducted. Moreover for ESIC the ceiling of 15000 should be taken into consideration i.e employee's having salary less than the mentioned amount are elligible for it.

Hi Getsie,
I am taking the liberty of being a little specific:
i] an employer has to start deducting & contributing PF right from day one; if an employee's salary [basic and da] is less than Rs. 6,500/- pm for sure; otherwise, it is optional [employer may or may not cover such employees]
ii] an employer has to start deducting esi, if the employer has 20 employees or more who are drawing a salary [basic and da] of less than Rs. 15,000/- pm; otherwise, the organization as such is not covered under esi.

Still have a doubt with the policies.
1. Does the staff member get a pf number to that effect even if he might have worked a few months or lets say he leaves within the probationary period due to whatever reasons between both parties...?
2. Does the company also contribute the same according to the deductions of that employee for those few months..?

Dear All,
As far As M.Govardhan's query, his company is new establishment and started with 13 employees. In such case suppose Mr.xyz who joined M Govardhan's is already member of PF ( before joining of M.Govardhan's Company, Mr.Xyz was covered under PF in previous employment) and in M.Govardhan's Company Mr. XYZ's basic+DA is less than Rs.6500/- . In such circumstance is Mr.Govardhan's company is to be required to apply for PF Registration and to cover all eligible employees? ....
In above scenario the provision of 20 or more employees for applicability of PF works (since his strength is only 13)?
Experts advice please.
