AnonymousThanks for your reply but the problem here is employer deduct ESI Contribution above wage ceiling 21000 from beginning of contribution Period (from October) and Submit to ESI and ESI accept his contribution (no objection from ESI till death of IP). Later on employee die on duty due to employment injury and when Family go to ESI, they refuse to give Dependent benefit and giving the reason IP was drawing salary more than ESI wage Ceiling. ESI contribution is deduct from employee salary and submit to ESI till death. now what can family do in this case.
