Dear Sir,
I have joined new company where there is 10 festival leave. 7 earned leave and 4.5 sick leave and there is no casual leave.
Is it correct as per labour law. I dont know whether my new company falls under shot establishment act or factory act.
Can you please share mandatory leave as per both act ?

if yours is a Factory ,Factory Act do not provide for casual or Sick leave or festival holiday.If it is a Commercial establishment then Casual , Annual ,and Sick leaves are governed by the S&CE est: Act of your state.For festival holidays you check the National & Festival Holidays Act of your state if any.If you are covered by ESI scheme you will get sick leave/benefit with cash from ESI.

Dear Mr. Varghese,
I have been told by my company that my company is 100% subsideary co of China Company . And our contract is renewed every year.
Hence suppose my company is registered under S.E Act then whether we will get the benifit of SL, CL, and EL.irrespective of whatever subsidiary.
And compny is providing only yearly 17 leave as per their chinesse HO. rule.

The word 'suppose ' shows you are not sure whether you are registered under F A Act or S&CE Act.If you are Regd under Bombay shops & commercial establishment Act You have to give leaves as per that Act which I think is not less than 21 days in an year.

Dear Mr. Varghese,
Thanks a lot for clearing doubts.
But our company is giving only 17 annual leave and they are saying that we have to follow their China Company policy.
Is it correct ?
If we are working in India irrespective of any Parent MNC Rule we should get leave as per indian labour law only. isnt it ?
Please explain.
