I am going to have overlapping services of 9 days because of my previous employer. My previous company has put me on garden leave, which I was unaware of as I never faced anything like this in my past five years. I asked for early release, and they said, "We will release you early; you apply for leave." I thought they were adjusting my leaves by reducing the notice period. So, I applied, and my leaves were rejected by my former manager. Therefore, there are no open leaves. Despite this, they marked my exit on 21st Feb, whereas I joined my current company on 12th Feb. I have proof that my leaves were rejected. What should I do? I informed my current company of everything within 14 days of joining. Will my current company terminate me?

Understanding the Situation
It's crucial to address the overlapping of services due to being placed on garden leave by your previous employer without your knowledge. Your concern about potential termination by your current company is valid, but there are steps you can take to resolve this situation.

Taking Action
1. [📅] Gather Evidence: Compile all documentation, including communication with your former employer regarding the garden leave, rejection of leave applications, and your joining date at the current company.
2. [📞] Contact HR: Initiate a conversation with the HR department of your current company. Provide them with the evidence you have gathered to support your case.
3. [📝] Formal Request: Submit a formal request to your previous employer, explaining the misunderstanding regarding the garden leave and the impact it has on your current employment.
4. [🗓️] Negotiate: Try to negotiate a resolution with your previous employer that allows for a smooth transition without affecting your current job.
5. [🔍] Review Policies: Refer to the labor laws and company policies in India regarding notice periods, leaves, and termination to understand your rights and obligations.

Legal Considerations
In India, labor laws protect employees' rights, including notice periods and leaves. If your previous employer's actions have violated any regulations, seek legal advice to safeguard your interests.

Communication Is Key
Open and transparent communication with both your current and former employers is essential in resolving this issue. Ensure that all parties are aware of the situation and work towards a mutually agreeable solution.

Seek Support
If you encounter challenges in resolving the matter independently, consider seeking assistance from a legal advisor specializing in labor laws to guide you through the process.

By following these steps and seeking appropriate guidance, you can address the overlapping services issue effectively and protect your current employment status.
