Dear Respected Sir, I was working in a company as a manager, but due to some reasons, the company started harassing me, filed a false police case, and terminated me. Within two days of termination, I launched a complaint with the labor commissioner's office in Mumbai. However, after six months of filing the complaint, on the third or fourth hearing, the labor commissioner's office stated that I am not eligible to launch a complaint there as I am a manager. They advised me to file a complaint with another department. Therefore, I decided to go to the labor court and filed a case of wrongful termination.

Currently, the company is intentionally causing delays in court proceedings. For instance, on the second date, they did not appear in court, and on the third date, they requested another date. They are resorting to cheap tactics to prolong the case and waste the court's time and mine.

I am seeking advice on how to handle this case because my lawyer is not trustworthy. He says one thing but does another.

How can I win this case?

How can I ensure justice is served? How can I strongly fight back? How can I prevent the opposing party from causing delays or being absent? How can I expedite the process to get earlier court dates, as currently, I am receiving dates that are one and a half months or more than two months away?

I am also undergoing this phase; however, my employers have not given me a termination letter. They asked me orally to stay at home and resume duties if they call me back, but nobody has contacted me. After two months of being jobless, I went to the factory gate and was turned away by the younger generation owners without a termination letter. Therefore, I have lodged a police complaint and received a notice from a lawyer to settle the issue. Now, I am awaiting negotiations for termination.

I hope they will send a termination letter, but I will accept it conditionally. I will ask for the past two months' salary, plus three months' future salary as a notice period, and gratuity as I have been working here for nine years.
