Hi all members of this forum. I was working with a company in Gurgaon and left the company in July 2012. Now I want to withdraw my EPF balance from the company. I collected the EPF form from the EPF office and went to submit the filled form to my previous company. However, the HR refused to take it and told me that she would not give the EPF money to me. Then I sent the form by courier to the company. One of my ex-colleagues informed me that the HR received my form, but she didn't take any action on it.

I checked my EPF balance online and found out that the company didn't submit all the deducted EPF money into my EPF account.

Questions Regarding EPF Withdrawal

Now, I want to know what I should do. Please, people, answer a few questions:

- How can I get my EPF balance from my previous company when they didn't submit my form to the EPF office?
- They submitted just half of my deducted EPF money from the salary. Will I get the whole balance of my EPF or just the submitted balance by the company?

Your query is incomplete. You need to answer the following questions to understand your case better:

1. Why is the company refusing to accept the PF withdrawal form?
2. Do you know your PF Number? (Yes/No)
3. How can you say that the company didn't deposit all PF deductions on your part?

Thank you for your response. Here are the answers:

1. The main reason why my previous company refused to give it is that I left the company without any prior notice due to some personal problems. Later on, I tried to contact the HR/Company, but they were not answering my calls.

2. Yes, I know the EPF number.

3. I calculated the deducted amount over 2 years, as mentioned in my salary slip, and found it to be significantly less than what was shown in the SMS sent by the EPF's official website. (As you may know, we can check our EPF balance online.)

Please advise me on the next steps.

Reason for Previous Company Refusal

Answer: It's okay; well, there are other ways out for PF withdrawal.

Knowing the EPF Number

Yes, I know the EPF number.

Answer: If you have your PF Number with you, you can withdraw your PF amount even without getting any signature from the previous employer. You need to fill out PF withdrawal forms and get them signed/attested by the Manager of your bank (Nationalised banks), Postmaster, or any gazetted officer, etc., and submit the same to the PF authorities for further withdrawal processing.

Discrepancy in EPF Amount

Because I calculated my deducted amount of 2 years, which is mentioned in the salary slip, and it was too little compared to what was shown in the SMS sent by the EPF's official website. (You better know we can check our EPF balance online.)

Answer: Yes, obviously, I know the procedure of how to check PF online, but I just wanted to know how you assume it is less. If there is any difference in the actual deduction of your PF (as per salary slips) and the amount submitted to the PF authorities by your company, then you can file a complaint to the PF authorities for action.

You can send your calculation to your previous employer if you have a salary slip. Politely, to resolve this matter, they have to submit the remaining PF amount (Employee 12% & Employer Contribution 13.61%) in your PF account. If they do not agree to this, you may take legal action against your previous employer because they committed fraud against you and possibly other employees.

Hi, thanks Gurgaon HR & Nisar for your replies.

@ Gurgaon HR - I discussed with one of my ex-managers, and we were working in the same company. I told him about your suggestion, and he informed me that he filed an RTI in the EPF office. The EPF office followed up on the RTI by itself, and the company had to transfer his entire balance into his account. He received all his EPF money in his account within 12 days. He suggested I do the same because no one will be easily ready to attest my form. Does it work?

Need not worry, you will receive your EPF accumulation. First of all, please confirm if you have your EPF number. If yes, kindly inform me about the EPFO your establishment falls under. Only then can I guide you on the next steps.

Issues with EPF Withdrawal and Online Record Discrepancies

Two issues have been raised in this query. One is the non-attestation of forms, and the second is the lesser amount shown in the online record of the PF office.

Employer's Obligation and Employee's Options

The employer is statutorily bound to attest or return the forms within 5 days of receipt; otherwise, on complaint, the employer can be prosecuted. The employee can get the forms attested by their bank manager or other authorities as mentioned in the forms and submit the same to the PF Office. In case the job was left before the expiry of one year from the date of submission of forms, the employee can obtain whatever amount is shown in their account. The employee must ensure that the amount shown in the account is related to EPF, as the amount of EPS is settled only if the service is less than 10 years.

Steps to Address Discrepancies in EPF Deposits

In case of any doubt relating to the non-deposit of the full amount, the employee can file a complaint with the RPFC. It's always better to get the amount transferred to the new establishment if joined, to have continuity of EPS benefits.

Nice to meet you. I suggest you consider a funds transfer through Form 13 (R), which is available with your existing employer, so that your service will continue without a break.

I think you are working in another company and are also a member of EPF/FPS. Why do you not transfer the EPF/FPS amount to your new PF account? Please fill out Form No. 13 and submit it to your PF Office, duly attested by the present employer.

In the balance inquiry, only the PF amount is shown; the FPS amount is not shown in the message reply by EPFO. For full details, register and log in for the generation of a passbook. You can see the full details of contributions month-wise.

Procedure for Transferring EPF Funds

The procedure is the same. You submit Form 13 at your present PF office in Delhi North, Delhi South, or Laxmi Nagar through your current employer. Funds can be transferred internally within the office, to a regional office, or to any PF office anywhere in India.
