Dear Members,
Which section of the Factories Act, 1948, or the Punjab Factory Rules, 1952, as applicable to the State of Haryana, allows us to take a maximum of 50 hours of overtime from the workers in a quarter?
Thanks in advance.

Overtime Regulations Under the Factories Act
Under Sec 64 (iv) of the Factories Act, overtime (OT) hours in any quarter shall not exceed 50.
Under Sec. 65, the Chief Inspector of Factories may grant an exemption of up to 75 hours in any quarter if he is satisfied that the exigencies and nature of work require overtime. The Chief Inspector has the power to grant up to 75 hours in a quarter and not more than that.

As far as FA 1948 is concerned, it states 48 hours, but in TN Factories rules, it is mentioned as 50 hours. Therefore, we have sent a letter to the Chief Inspector of Factories seeking clarification. We will follow national law based on the clarification provided.

Dear Member,

Understanding Sections 64 and 65 of the Factories Act
Section 64 and 65 both relate to the power to make exempting rules and the power to make exempting orders, respectively. In my view, we are not in a position to require workers to work overtime in accordance with Section 64. Section 64(4) of this Act has set out certain limitations when making rules for overtime work. The appropriate State Governments, when making the rules, must consider these limitations. Thus, the State Government is not authorized to make rules beyond these limitations. However, the State Govt./CIF, under Section 65, can grant exemptions for overtime work up to 75 hours in a quarter based on certain conditions. Therefore, if there are no rules regarding overtime work, how can we require workers to work overtime without proper permission from the CIF/State Govt.?
Question on Punjab Factory Rules, 1950
My unanswered question is whether the Punjab Factory Rules, 1950, as applicable to the State of Haryana, allow us to require overtime work without proper permission from CIF Haryana/State Govt. If there are rules regarding overtime work up to 50 hours in a quarter, please inform me about the specific rule for Haryana.
Thank you for your response.

Dear member,
No permission is required from CIF in Haryana for overtime (OT) up to 50 hours in a quarter. Only the payment needs to be made at double the rate, and ESI deductions for the employees covered under it. However, permission is needed for OT on holidays at least one day in advance.

We are discussing OT for workers, but who is a worker under the Factory Act and ID Act? If we will not pay OT to any supervisory staff, management staff, and individuals falling under the staff category (I understand that staff is not reflected in any Act), how will the matter be resolved? Who is eligible, and under which Act? If a plant is not ready to pay OT to any supervisory staff (as per the ID Act), can he/she be eligible for OT under the Factory Act?
Kindly provide valuable advice to get a clear picture.

As per Section 64 of the Factories Act, 1948, except in the case of urgent repairs, the total number of hours of overtime work can't exceed 50 for any one quarter. What I gathered from your query is that you are looking for information under the Punjab Factories Rules, 1952, where it is mentioned.
Factories must abide by both the Act and Rules. In the Punjab Factories Rules, 1952, in Form No. 20, i.e., Abstract of Factories Act, it is also clearly stated.

Overtime Payment Discrepancy in Factories
As per the Factories Act, all individuals employed in a factory are considered workers. Then why is overtime paid only to labor category workers (blue-collar) and not to supervisory or managerial level workers?
