Hi I am an HR in an E-learning company based in Pune. We have a strength of 25 employees and will increase gradually. this company is a startup, and is about 2 years old now.. i basically would like to know that are labour laws applicable for this kind of setup. If Yes then which are those and if no, then the reason for the same.. Please suggest.

Since yours is an ITES organization, basically it is covered by the State's Shops and Establishments Act. By virtue of your present strength of your employees and the likelihood of its gradual increase in future, all allied Labour Laws such as the Industrial Employment (Standing Orders )Act,1946, the Industrial Disputes Act,1947, the Minimum Wages Act,1948, the Maternity Benefit Act,1961,Payment of Bonus Act,1965, the Payment of Gratuity Act,1972, the Equal Remuneration Act,1976 would become applicable too. Since the numerical strength of employees is an important criterion for application of certain Acts mentioned above, it is better to see the relevant Rules framed by your State for clarification.
