Dear Seniors,
Kindly clarify the following service tax problem
XYZ & Co. is a authorised dealer for 2 wheeles partd dealer , purchase parts from its supplier and sale to its Dealer & customer. In addition to the regular profit on sale of Parts , XYZ & co. also received incentive on monthly, quartely & yearly basis from its supplier which depends on achievement of sales target as decided and intimated by its supplier from time to time. My question is whether such incentive received is taxable under service tax act and under which category.

Incentive is part of Sales promotion. Service Tax will apply on such payouts. If such incentives are outside the purview of Service Tax, most of the companies may pay major % thru incentives/bonus in order to escape from ST liability.
