My question is that what if the employee have crossed the limit and still for this the contribution continues will he be getting the benefit in continuation and if so, till when. Regards Kim

If the employee crosses the ceiling limit of the wage in the midlle of the contribution period, he continues to be an employee for the purpose of ESI benefit till the end of the contribution period and the corresponding benefit period.

In reference to above said.
There are 2 Half Yearly returns cycle under ESI Act.
Apr to Sept and Oct to Mar. So during this cycle, let's say Employee Gross salary was less than Rs. 15000 till May i.e. employee has paid the ESI amount for the month of Apr & May. If employee's Gross crosses Rs. 15001 as of June, still ESI will be deducted from the Employee & Employer till September.
From Oct onwards a new cycle will start & hence the deductions for the above said case will close.

As explained by Vinod is correct. Would like to add one thing, in the corresponding period he will get the benefit of ESIC. regards

Dear Seniors,
We have a peculiar case coming up. One of the employee is covered under ESI and his wife is getting treated at an ESI hospital. She is likely to get operated in a month or so.
The employee's wages will cross the limit with effect from 1st April 2012.
Is she eligible for treatment from 1st April onwards?

Hi Kangeyan,
As the employee has made contributions from Oct'11 to Mar'12 - he will get the benefit for the next 6 months i.e. from Apr'12 to Sept'12.
I hope there shouldn't be a problem in this regard.

I agree with Kumar Vinod.
We have 2 'Contribution Period' which is followed by 'Benefit periods'.
For Contribution period from April - Sept the Benefit period starts from January till June & for Sept- March Contribution period the subsequent benefit peiod starts from July till December.
Hence Anybody who has been on contribution period can avail the benefits till the end of the respective Benefit Periods.

As per act, once the company is taken over / merger it is nothing but a sister company. In such a case, if employee's are not to be allowed to withdraw their PF amount, but instead one has to insist employee's to apply for a PF transfer.
Irrespective of Old or New Company, they shouldn't sign the claim form, reason being employee is till working with a Parent company and if we are authorizing the said document, it would be a breach of Non Compliance & said person can be sued by PF dept.
Please take appropriate steps on the same.
I would rather suggest, apply for a PF transfer.
