Dear all, I have worked in a bank (IDBI) for more than 3 years since July 2017 and recently resigned from service and got relieving on 28 October, but before that in August bank promised to pay a bonus for work during the covid peak months from March to July, hence all details were already entered in the system and I were to receive 8 days worth salary as a bonus from IDBI, in spite of filling all details for receiving bonus bank delayed the credit of bonus for 3 months and credited the sum to all receivers on November 7, but I have received no such bonus amount (I had got relieving on 28 October itself ).

Here the circular for such bonus didn't mention that if anyone will resign he shall not receive the same, also the bonus value was considered for the period while I was in service, and all the approvals and all the attendance records were also updated in the company software, in spite of that company has failed to credit the bonus in my account.

Please help as the amount is 26000, it is a decent amount for a middle-class man like me, I can't let the bank have it, I have emailed HR department and got a reply that - " all needful for bonus has already been done", that is they are refusing to give me my dues, I emailed the HR head and got no reply I also mailed CEO and got no reply, this is a very dangerous scenario as to how can a bank withhold my rightful payment.

I have -

1. Email conversation regarding this incentive/bonus payment.

2.My relieving letter

3.My bank statement showing no credit on 7 November.

Dear Rohan Sharma,
For the non-disbursal of the bonus payment, you have approached HR Head as well as CEO. From these functionaries, you have received a reply from the former but not the latter.
Against this backdrop, I recommend you write a detailed letter to the CEO stating why you are eligible to get a bonus. Send the letter by Speed Post with CC to the HR Head. Let us wait for their reply. Depending on the type of reply, we will decide what to do further.
In the meanwhile, please confirm how many persons reported to you when you worked in the bank.

Mr. Dinesh , i was assistant manager , none people reported to me , i reported to the branch manager who reported himself to the regional head and so on.

It appears the reference is not for the statutory bonus but a special incentive being given for the work done during covid times. Since the Scheme did not have any exemption and you got assurance of its payment, my suggestion is that you write to them seeking immediate payment failing which threaten them to expose them in the media. I wonder whether the Bank Ombudsman can help in the matter! What about the Unions, are they of any help?

Banking ombudsmen is of no use here , i am sending a letter by post demanding my money , if they fail to do so i will send a legal notice and file a case in labour court.

If it is not about statutory payment, labour court will not be able to help you.
Since the payment in question is incentive payment, only Bank management
can help you. You can meet the chief controller of your bank and try to discuss
the problem in person.

was there any circular in regard to payment of bonus or incentive for said period working circulated by the company and if it is so
Write letter to your HR giving the reference of circular wherein company committed to pay for rendering service during the notified period and if then also no concurrence is there. you may proceed directly to labour office for the redressal of your grievances .
Under section 33 c(2) of ID act you can directly appeal to Labour tribunal for the payment of bonus dues adducing the circular issued by company for the payment of incentive/bonus for said period working.
