1) if one is eligible for getting Grauity after 4.9years of continous service
2) If yes , let me know procedure for applying for the same .

If in the 5th year the concerned employee has completed 240 days even then he would be eligible for gratuity.

the Payment of Gratuity Act, 1972, making it mandatory for all employers with more than 10 employees to give them gratuity.

Employees, as defined here, are the ones hired on company payrolls. Trainees are not eligible and gratuity is paid on the basis of the employee's basic plus dearness allowance if any.

You become entitled to a gratuity on resignation or on retirement after five years or more of service

In case of death of the employee, the heir is entitled to the gratuity immediately and the entire amount is tax-exempt.

The employer could also offer you an extra gratuity by deducting a portion of your salary as the cost to the company. At the time of joining the organisation, ask your employer for all the details concerning gratuity and how to calculate it.

To meet its liabilities towards gratuity, a company either funds the money from its own pocket, or opens a trust and puts in money for the gratuity fund. This fund is then managed either by an insurer or an actuarial company.

Revised Gratuity is Rs.3.5 L to 10 L

As per Chennai High court judgement, if a person put continuous service of 4 years and fifth year 240 days and he resigns from the services he is eligible for Gratuity.
If the employee not completing his services for five years and he dies, retrenched from the services we have to pay the gratuity to the services they rendered.

yes exactly in 5 th year, contineous completion of 240 days can be eligible for gratuity.
i am the example for the same. i had receive the gratuity in 2005 when i completed the service of extact 4 years and 9 months.
simply get and fulfill the form and ask your employer to submit it properply, you will get gratuity amount with in 2-3 months in your bank account (account described in the form). Please make sure the bank account should be open and active which you described in gratuity form.

Hi As per the Act one can eligible for grauity is only 5 years continous service but 4.5 years also conunted as 5 Yrs service. hope you are clear.

Hi,
Any employee who worked for 4 years & 8 months is eligible for getting gratuity.
The process is that you have to send a letter to lic with information about date of joining & date of leaving, Last basic salary etc. After that they will send you the cheque by post.

as perb payment of gratuity act 5 years service is mandatory to become eligible for gratuity.
if madras high cout has given judgement for 4 years and 240 days in fifth year ,still it can not become a law.so on the basis of that judgement we can not say that eligiblity to get
gratuity is reduced from 5 years.
so dear eligiblity can not be decided by one judgement and it will remain five years

If an expert is not answering question or till we get a correct answer fron an expert members from this forum can mis lead new comers which I think a dangerous situation
