If the 'employee' is a workman coming under the scope of the Industrial Disputes Act, they will get justice from the Labor Officer of the area where the establishment is situated.

Definition of a Workman

A workman means an employee who has no managerial rights. Simply appointing an employee, initiating disciplinary action against an employee, approving leave, appraising performance, etc., are considered to be managerial rights. An employee who does not possess any of these rights will come under the scope of a workman, and such an employee will get the protection of the ID Act.
