Greetings Seniors..

I have served this company more than 10 years and worked in middle level. Recently I have terminated by the company for inappropriate reasons, though I have no way responsible and even the complaint was filled by me only.

This incident happened 1 year before, formal enquiry was conducted throughout the year, but my boss and super boss informed that, no action will be against you, since you no were connected this issue. But i have suspicious about my company, because they are always not favour to employees, that is the reasons, NO EXPERIENCED PEOPLE JOINED THIS COMPANY.

Now I have suffered heavily, because no other company not taking me, because of my termination letter, I have spoken with my seniors and HR, they are not ready to help me to issue experience letter so far.

Initially I planned to file a case through labor court, but my total family (parents, wife and children's) depending on me, because I am the bread winner for my family.

I am totally not accepted this decision, because I am very loyal to my company, every one knows my character, but the person who is taking decision sitting in somewhere and took this decision without knowing me and my past records.

Now I got very small job, the salary is which very low, when compared to my previous company (3 times less) but they don't want relieving letter.

My question is, Can I file case against my previous employer now (4 months is over now) till such time can I work with this company and get the benefits from them?

Dear Meesamathavan,
I feel sorry for you.
You should approach a good practicing advocate in labour court with all the papers of your employment and your termination including the papers partaining to the charges levelled against you by the company which led to termination of your services. You need to take the steps as per the advise of the advocate.
I would not like to give legal advise to any body with out seeing the papers and studying the matter. But one thing I wish to mention here that you may win in the battle but to win this battle you will have to spend your time, money and energy. Mental tension may make your routine life miserable. Decision you have to take.

from your post I am just slightly confused of the situation.

You were the one who complained regarding some situation and you were terminated with regards to the situation.

DO you mean to say they framed you or something like that?

Unsure and really at wit's end to understand how can a management frame a person and terminate a person who is lodging a complain and has done no bad?

What is the reason of termination stated in the termination letter?

Only if you think you should, I think the whole story will be good so that we can judge better.

Again since we are unaware about what incident happened a year back?

From this all that I can understand is some situation occured, you complained, your seniors made you believe that since you're nowhere involved there will not be any effect on your employment and yet your recieve a termination letter.

Another thing. Somewhere in the end of the post you mentioned 4 months.

4 months of what?

I think the post still lacks the clarity and is open to be concluded the way in which anyone wants and honestly, people will interpret in their own way and start giving you options which might not suite you as the assumption of situation might be wrong.

Hello Meesamathavan,
While Keshav Korgaonkar has given you very practical & realistic advice, Ankita Shah's response does point-out to gaps in what you mentioned.
While your situation does SEEM that it can be resolved only legally, you can get more focused suggestions from the members of this Forum IF you can give AS MANY DETAILS as possible.
Suggest give complete details WITHOUT mentioning the company name or other individuals--what matters finally is the problem details, NOT individuals or entities.
@ Ankita Shah--I think he means that it's 4 months since he left this company & joined in a smaller one.

This issue was raised by me to my seniors, but there was no action taken by them, later when our audit department came to our branch, I informed this issue.
But they issued me charge sheet with other colleagues after 1 year only, and asked me to go after 18 months of this issue.
Now four months is over, I don't have any good or equilavent job, and working in a small company with low salary, can I fight with them?
