The name of the application form is "Form-F." As mentioned earlier, the Punjab Shops & Commercial Establishment Act of 1958 is applicable to UT Chandigarh, Punjab, and Haryana. Please determine the location of your establishment and obtain the form from a local book-seller in your city, then submit it to the area Shop Inspector.

Hi Mr. Khola,

I wanted to check that according to The Punjab Shop & Commercial Establishment Act as applicable to the State of Haryana, an employee is entitled to have seven days of sick leave and seven days of casual leave in a year. According to section 14(1)(a) of this Act, every employee who has been in employment for not less than 20 days in a year shall be entitled to one day's earned leave for every such 20 days.

Does this mean 20 normal calendar days or 20 working days? We work 5 days a week, so the maximum we work in a year is 21-22 days, and we are confused about whether we have to provide leave based on 20 working days or 20 calendar days. If it is 20 working days, we need to present this to management. Is it mentioned or written anywhere as proof?

Please suggest as this is very urgent and important.

Dear,

Under this Act, we are to grant earned leaves considering the employment days and not the actual working days. You have also read the same sentence in the Act. Therefore, implement the law in its true spirit. In my opinion, the Act is very clear that we are to grant EL based on employment days and not the working days.

Dear Fateh,

You have to submit Form F, Form A, and Form B along with the lease agreement or a similar type of document as proof of the commencement of work. Additionally, you need to submit Rs. 5000 if the number of employees is more than 9. You can make this payment at the SBI bank and obtain the signature and stamp of the treasury officer at your respective location. Subsequently, you can submit the forms to the local labor inspector. The labor inspector may request Rs. 1000 as a red cross fee, which is not mandatory under this act.

These forms are available for purchase at any bookshop or stationery store. If you are in Haryana, you also have the option to complete this process online.

I have a query regarding the Haryana Shop and Establishment Act of 1958. Is this act applicable to the construction industry (specifically as a contractor)? The reason for my confusion is that the Act does not explicitly mention its applicability to temporary site offices.
