Hello, can anyone help me determine if I am eligible for a gratuity claim?

I worked in an organization from May 2000 to July 2006 in various designations. However, after resigning from that organization, I did not receive any gratuity benefits. When I inquired about gratuity, I visited the office and discussed it with the depot head. He informed me that no provision was made for gratuity when I joined, so I am not entitled to its benefits. Am I eligible for gratuity? If so, how can I claim it? What is the applicable period post-resignation? Please advise.

Since you have put in more than five years of service with the establishment, you are eligible to receive gratuity. It is immaterial whether the employer had provided for the payment of gratuity or not. Provision for gratuity is their obligation only.

In order to claim gratuity, please submit Form I. You can find Form I by searching for "Gratuity forms."

Thank you for your response, sir. I went there and asked for gratuity; they told me that they are unable to provide it. What should I do next? Whom should I complain to and how? After resigning from that organization in March 2006, a significant amount of time has passed. Please advise me on what steps to take, sir. Once again, I am thankful to you, sir.

You may apply for gratuity in Form I with a covering letter. If you do not receive gratuity, you can raise the issue with the District Labour Officer, who is the appropriate authority for the Payment of Gratuity Act.
