Unfortunately, due to my personal reasons, I just left the employer without serving the notice period. When I approached the employer to claim my PF amount, they were not helping me out. They were supposed to certify me and assist in claiming my PF amount, but they are not doing so. I have my PF account number with me.

Can anyone suggest how I can claim my PF account without involving the previous employer? Is there an option to approach the PF office directly?

As far as my knowledge goes, there is no such provision to claim your PF without the employer's signature. However, if you have a valid reason, you may visit the PF commissioner and obtain their signature in place of the employer, with the assistance of your lawyer. You will need to fill out the form along with a complaint letter and have it signed by the PF commissioner, who will then forward the form to your previous employer. If your employer does not respond, the PF commissioner will take immediate action. This seems to be the only option available to you. Let's wait and see how the seniors respond.

I do agree with Balaji's comment. In addition, I would like to add that for the withdrawal of PF, there is a provision to obtain attestation from a Bank Manager or a Gazetted Officer. This will be applicable only if the employer has closed that unit, for whatever reason.

Hi friend, I do agree that those things are possible only in metropolitan cities. If you visit any district-level offices, they will not accept the form without the signature of the employer. In case the employee has a lawyer, they may compel the employer to provide the signature; otherwise, it is not an easy task at district-level PF offices.

First of all, speak with your previous employer and explain the inability to serve the notice period and get properly relieved. This will benefit your future employment prospects.

Although you have the right to withdraw your PF accumulations, it is best to transfer them to your present employment account or to the account you will be joining.

However, the following information is for your reference:

Procedure to withdraw the PF amount

Step 1: You can contact the local PF office and collect Form 19 and 10C, or you can download the withdrawal form in Form 19 and 10C, NSSN Form from the [EPFO](http://www.epfindia.nic.in) website.

Step 2: Fill in all the details about yourself and provide your savings bank account number in the forms.

Step 3: Open a savings bank account, preferably with a nationalized bank. Mention the account number in forms 19 and 10C and attach a copy of the first page of the passbook.

Step 4: Send the complete set of forms with enclosures to your previous employer for forwarding the forms to the PF office.

Step 5: Obtain attestation from the bank manager for sending the claim directly to the PF office, if desired.

Step 6: Send the forms to the PF office where your previous employer has accounts by registered post.

You will receive your money in your bank account within 45 days.

Procedure to transfer the PF amount

Step 1: Collect Form 13 from your HR/Personnel department of your present employer, or download the form from the EPFO website.

Step 2: Fill in all the details regarding your PF account with the previous employer, including the name and address of the employer, and sign the form.

Step 3: Submit the form in triplicate to your present employer's HR department.

Dear Sathish,

Greetings for the day.

Your EPF accumulation can't be stopped by the employer. You have your EPF account number. Simply fill Form 19 & 10C and enclose a complaint letter with the form which accompanies the fact that your previous employer is not signing the withdrawal claims. Submit the same to the concerned EPF office. The EPFO officials are competent enough to take action against the employer. Secondly, if at present, you have an EPF number with your present company, then transfer your accumulation by simply filling Form 13.

Dear All HR Veteran,

Please ref. below few steps for EPF Claim without employer signature;



Step 1

First download and fill up Form 19 (for EPF withdrawal) and Form 10C (for EPS Withdrawal)

Step 2

Get it attested by any one of the following

Manager of a bank (PSU preferred)

By any gazetted officer.

Magistrate / Post / Sub Post Master / Notary

Step 3

Write down a letter addressing the regional PF commissioner, stating the reason why you have to get it attested and how you are facing issues with your employer. In case you have any proof of unsupportive behaviour from your employer, better attach it. (This step is optional, and not mandatory)

Step 4

If you are unemployed, you will have to make an affidavit that proves that you are unemployed. Download this Affidavit Sample and get it printed on a Rs. 100 stamp paper with a notary or any gazetted officer signature on it (This Affidavit is part of our Jagoinvestor Wealth Club) . This is required because you need to be unemployed if you want to withdraw your EPF . If you are employed, you can transfer your EPF to your new employer.

Step 5

Send these forms to your regional EPF office and wait for next few months for some kind of action.

Step 6

Once your application is processed, the EPF withdrawal request will be honoured and you will be paid. If you still don’t see any action or response, then its time to File an RTI application to EPF Department for finding out the exact Status.

Legal Action against your past employer

Note that Employee provident fund money is totally yours and no matter what the situation, your past employer should be helping you in withdrawing it. It can be some issue your employer or you might have.., your employer can not say that they will not give signatures and create issues in your EPF Withdrawal.

If that’s the case, it might be time to teach them a lesson.

If you are 100% sure that you are correct and it’s a case of harassment, just collect all the documents which proves the harassment and then inform your regional Provided Fund officer about this. He will carry out an enquiry, contact the employer and if he finds them guilty, there can be legal action against the company and might even amount to imprisonment. It’s the Employer’s duty to keep records as per the law and also maintain the terms and conditions, failing which employer can get a notice under a section 7A, which lays the guidelines of strict actions against your past employer.

For transfer of PF amount — - It is not mandatory for getting signature for PF transfer form. You can put your present employer signature — and it is enough.

Hi, I have a doubt regarding PF deduction. In my company, my gross salary is Rs. 16,484. After the deduction of PF and gratuity, my net salary is also Rs. 16,484. However, my salary credited is only Rs. 16,121.

You can withdraw your mother's EPF in the following ways: First, you should know the EPF number. The UAN allotted to the member should be activated, and nominee details should be updated using the UAN portal. Next, fill out Form 19 and 10 C and have them attested by any Class I Officer of the Government, including the Central Government, or a notarized advocate.
