We have some employees who are covered under ESI, and the rest of the employees have been insured through the Group Health Insurance Scheme and Personal Accident Insurance. Despite that, is it necessary to take insurance under the Workmen's Compensation Act.

Dear,

Neither is it necessary nor legally required to take insurance cover under the Workmen's Compensation Act. Those whose salary is up to 10k might be covered under ESI. I personally do not feel inclined to provide insurance cover under the Workmen's Compensation Act to those who are not covered under ESI. They will not benefit significantly from the Workmen's Compensation Act as their nature of the job is not as such.

It is advisable to get an insurance policy for those workers who are not covered under the ESI Act, 1948, and are covered under the definition of a worker under the WC Act, 1923, from an insurance company.

It is also sufficient if you could benefit under these schemes and then payment may be made to the affected workman in accordance with the W.C. Act, 1923.

Is it permissible for a company to claim an amount from an insurance company under a Personal Accident Insurance Policy and pay a lesser amount to the nominees of the workers based on calculations reached through the Workers' Compensation policy?

Under no circumstances, it is possiible to claim more from Insurance Companies and pay less as compensation.

If the workman is covered under the WC Act, 1923, then the employer has to pay compensation in accordance with the provisions of this Act only.

Yes it is compulsary, if the person is not covered under ESIC then the person to be covered under WCI ACT, Even if the insurance is taken.
