Hello,

I have been denied performance-linked variable pay for the period I was on maternity leave. Is this fair? Should I not be paid the amount calculated as per the average rating for the period I was on maternity leave?

Applicability of the Maternity Benefit Act to the IT Industry

The Maternity Benefit Act of 1961 is applicable to the IT industry. The relevant section is provided below:

Sec. 2(b) - Application of Act: (1) It applies, in the first instance, to every shop or establishment within the meaning of any law currently in force regarding shops and establishments in a State where ten or more persons are employed or were employed on any day of the preceding twelve months.

As the IT industry is covered under the Shops and Establishments Act, this Act is therefore applicable to them.
