Okay, so I wanted to resign from the BPO company I was working at on probation from 21st January 2014 to 21st July 2014, and I had to take emergency leave for around 2 weeks.

Question About Probation Leave Policy

Now, my question is, since the company's policy doesn't allow any leaves during the six months of probation, will my managers ask me to complete those 2 weeks of attendance along with the 1 month notice period? Please help.

My team leader had left, and the new caretaker is a bit of a spoilsport, so now I'm in a mess.

Leave Provision During Probation Period

Don't you have any leave provision during the probation period? If not, the leaves taken by you may be on Loss of Pay (LOP) or considered as advance leaves. There is no link between the notice period and leaves already availed.

I don't know the leave policies of your company.

Apart from what Pon has replied, please elaborate on whether the 2 weeks of emergency leave was taken during the Notice Period. If so, then yes, you have to complete the 1-month notice period excluding the leave you have taken. If the leaves were taken earlier, then please check your salary as the leaves would have been considered as LOP (Loss of Pay) and must have been deducted from your monthly salary.

If the leaves were taken in earlier month, then the same must have been deducted from your salary as LOP, hence you are liable for 1 month notice only as per the Termination clause.

The company policy shall prevail, i.e., since leave is not admissible during the probation period, it is immaterial whether you availed emergency leave during or prior to the notice period.
