We are a manufacturing company in Chakan, Pune, Maharashtra covered under Factories Act, Maharashtra Rules.
Is it complusory to declare Gandhi Jayanti as National Holiday ( as the Act or Rule does not speak about declaring any day as Complusory Holiday )

Factories Act does not speak about holidays but holidays are declared following the State Act, say, (Maharashtra) Industrial Establishment (National and Festival Holidays) Act under which Jan 26th, August 15th and Oct 2nd are National holidays. Also many State Acts have made May 1st (May Day) as national Holiday.

Dear members As far as I am aware, Maharashtra does not have National & Festival Holidays Act, therefore a Factory can chose not to declare October 02, as a holiday. Regards Preetam Deshpande

That doesn't mean that you can work on a national holiday which is declared as such by the Govt. of India. It is right that in Maharashtra there is no legislation regulating holidays in factories (it is surprising also!) but the public holidays are to be observed as such and accordingly, you have to observe January 26th, August 15th and October 2nd as Holidays.

Is it compulsory to declare 2nd October be declared a holiday for an International BPO calling UK and US which is based out of Kolkata.

Whereas under Shop and Establishment Act 2nd October is also Compulsory Holiday.
Manufacturing Units is Maharashtra need nor observe 2nd October as Holiday.

National Holidays should be declared as Compulsory Holidays, but sometimes its not viable to observe Holiday for all i.e. Hotels/restaurants 24x7, call centres etc so the company can pay extra to the employee who is working on such holidays

Engaging employees on a national holiday on payment of double the rate of wages is another issue. The issue raised here is whether Gandhi Jayandhi day should be a closed holiday for Factories and since the Factories Act does not have a specific provision about it and in Maharashtra there is no Act which regulates holidays for industrial establishments unlike Kerala Industrial Establishments (National and Festival Holidays) Act or Karnataka......Act.
Even calling the employees on national holidays shall only be done by issuing notice in the prescribed form and informing the appropriate authority of such engagement on a national holiday in advance and no hotel or IT firm can engage workers without such notice. It is true that hotels and other establishments have obtained permission to work for 24X7 hours but that does not mean that they need not observe holidays or the workers shall be denied holidays. The flexibility with regard to timing is granted on certain conditions and we should go through the conditions attached to such permissions before declaring that we can work on national holidays.
