In our company, more than 100 workers have been working for one year. Neither a trade union nor an elected representative exists in our company. Management is forcing me to certify the standing order within three months.

Certification of Standing Order

In the absence of a trade union and elected representative, can any company certify the standing order? Is it certified under the Model Standing Order Act Maharashtra rules or Chapter No. VII under the Bombay Industrial Relations Act?

Please guide on the above query.

u must make standind order as per the rule of standing order and certification act within six month after the strength of 100 employees.

The industrial employment standing order is already applicable to our company. However, if I want a certified standing order, is it possible to obtain one in the absence of a trade union and an elected representative?

First of all, is your company covered by the Bombay Industrial Relations Act or the Industrial Employment Standing Orders Act? You have to ask your management if any amendments are to be made to the standing orders. If so, you have to submit five copies of the amendments to the certifying officer.

As per Section 5 of the Standing Orders Act, once the standing orders are submitted for certification, it is the duty of the certifying officer to send a copy to the workers if the union is nonexistent, and the rest of the process is to be complied with by him. You just need to complete your part of the obligation.
