We have more than 100 employees in the company. Is it a mandatory requirement to apply for the certifying Standing Order? If not, which standing orders will be applicable to us?

If your industrial establishment employs 100 or more workers, it is mandatory for you to draft Standing Orders and get them certified by the competent authority of the State's Labour Department. Even otherwise, it is always desirable to have standing orders as they are a basic document that defines the relationship between the employer and the employees.

Also, it should be an "industrial establishment," as defined by the Payment of Wages Act. It should be an establishment of a person who, for the purpose of fulfilling a contract with the owner of any industrial establishment, employs workmen; it should be an establishment of a class notified by either the Central Government or the State Government concerned.
