The Contract Labour (R&A) Act, 1970 does not have any provision relating to working hours and overtime. Although under the Rules, we are required to maintain the OT register. The Form number may be different in central and state rules. The Rules are also silent on this topic, but while going through the conditions of the license, this topic of hours of work and other conditions of service has been touched upon. Therefore, please review the conditions relating to the grant of your license.

We have taken man-hours worked in a month. How do we show overtime for contract workmen? The labor department has questioned the payment of:
1. Overtime to contract workmen under Section 59 Rule 78 C.
2. Issue of OT slips.

We do not have an electronic attendance recording system as of now, and the employees working at the factory, including non-management employees, sign in a register. Despite working more than 8 hours, we do not have a policy to pay overtime.
My question:
1. Is overtime mandatory for all staff members, whether management or non-management staff?
Biometric attendance will automatically capture the timing; hence, do we need to pay overtime?
