Hi, If somebody can tell me what are the rules for Sick leave. Can sick leave be taken if a family member of the employee is ill. Please let me know the source of the information also. Thanks

Dear Rajni,
Sick leave/Personal leave/casual leave etc (with the exception of Earned leave) is guided by company policy. Normaly if leave is taken, if a family member of the employee is ill, it is called Casual leave. However as I mentioned please check your company leave policy if provisions for casual leave exists. Sick leave can be taken only if you are sick. However you may take sick leave for few days without any proof (medical certificate), since there are diseases that can be treated at home without refering doctor.

first of all , any type of leave , you can not claim as a matter of right.
and you can take the sick leaves in your own sickness only. The nos. of sick leaves depend on state act. in haryana and punjab it is 14. but if you covers under the esic act. you are ot eligible the sick leave.

First examine which of the enactment is applicable to your establishment with regard to grant of sick leaves e.g. State Shops & Establishment Act, State Industrial Establishment ( National & Festival Holidays and Casual & Sick leaves) Act etc. & then go through the provisions/ Rules relating to grant of sick leaves in that particular applicable Act.

The importance of attendance in any company can directly impact the success on career or we can say future. If you have exceeded sick days for the year, and as a result, They give additional “no pay” sick days. Although "NO" company does not pay salary to those individuals that have exceeded the allotted sick time, the impact is much greater from the standpoint of creating savings and generating income for Individual companies. Normally all the corporate sector's gives 5 sick days each year. Sick days are not to be treated like vacation days and should only be used when necessary. Any Organisation does not expect all sick days to routinely be used. Sick days are used in situations where you physically or mentally feel that you cannot perform at a high level.

If an employee takes leave on a basis of family member's sickness it comes under casual leave. In my co. we deduct sick leave maximum 3 days after that he must submit medical certificate. And no one can mix two leaves. Suppose an employee have 2 sick leaves balance in his A/c and he takes 5 leaves. He can not do as take 2 as sick leave and balance as casual. He either takes 5 casual leaves or rest 3 day will his LOP.

This leaves is eligible only for absence due to your own health disorders. To avail the above leave more than two working days employee should submit proper medical certificate. If the absence days overlap tolerance days balance days should be treated as Leave without pay.

An employee can avail sick leave if he falls ill. He cannot avail same for his family members. Sick leave policy varies from organization to organization. Usually (in many companies)there is no need to submit medical certificates if an employee falls ill upto 3 days. If the same exceeds beyond three days there is a need for the employee to submit medical certificates to the concerned HR department. In our company there are 7 sick leaves which cannot be encashed
