Guidelines for Obtaining Form No. 16
My past company did not provide me with Form No. 16. They deducted more than Rs. 30,000 for Income Tax from my salary before I joined my new company. I have received my remaining full and final amount from that company, but Form No. 16 is still pending.
I have been in touch with my past company for the last three months through email, requesting multiple times for them to provide me with Form No. 16 so that I can file my Income Tax Returns. Without Form No. 16, I am unable to file my IT Returns and claim the deducted Rs. 30,000.
Currently, the HR person from my past company does not even pick up my phone. What should I do?
Please note that my past company was an MNC, and there is no room to doubt the submission of the deducted Income Tax amount of employees to the Income Tax Department. They may have regularly submitted this amount, but the issue lies in not providing Form No. 16 to the past employees.

If you are asking about your Form 16 from your past company, they should provide it after one month of the financial year. This means you should receive Form 16 after 30th April 2010 for the AY 2009-2010. Also, if tax is deducted from your salary, they should provide Form 16. If they are not providing the same, write an email to your HR and Accounts department, keeping CC to the Income Tax department. You can obtain the email ID from the Income Tax official website.
