Dear Sir/Madam, I am writing this with the hope of getting the right guidance on the issue below. The sales incentive was for the sales done between July 2018 and December 2018 (6 months). As per the notes mentioned in the incentive circular, note number 1 stated that the incentive was to be paid by the end of February 2019. To date, as of 31.05.2019, it has not been given to any team member. Also, note number 3 stated that a person leaving the organization would not be eligible for the incentive, and the replacement would not be eligible for the incentive earned by the previous person.
I submitted my resignation on March 6, 2019, and served a notice period of one month instead of the three months mentioned in the offer letter. My new employer is buying out the notice period (2 months) which I did not serve, and I have communicated the same to my previous employer. Now, when I am seeking my full and final settlement from my past employer, they are denying to pay me my incentive of Rs. 90,000/-, which was to be paid by the end of February 2019. I feel needlessly harassed and believe I should seek legal assistance in this matter.

You have shared the company policy, but do you have any proof available for achievements against this? For example, email communication, a letter, or something from the company? With available proof, you can register the matter and prove it in a court of law. There is nothing wrong with fighting against the company for your rights and earned money. Register a case; you will get free help from the government for this. However, take care never to share the original proof with anyone without having another copy.
