The issue now is that when I called HR to confirm my Full and Final (FNF) cheque amount, they told me it was around 8600/-. However, they calculated the salary from 20th June to 20th July and provide the salary on the 1st of the next month. I resigned on 7th August 2015, but they are calculating the salary from 1st August to 7th August. They are not considering the FNF amount from 21st July to 7th August. Additionally, they are also delaying the gratuity amount. They informed me to wait for 2 months for the gratuity amount as they haven't sent any documents to the LIC office. The cheque will come from the LIC office. Please help me, what should I do now? It's been almost a month, and I still haven't received the correct FNF amount. Please help, sir.

Hi Pramod, what your company said is true. As per Section 4(A) of the Payment of Gratuity Act, the company has to tie up with LIC agencies for the gratuity amount. Usually, it takes less than 1 month, but anyway, please contact the HR of your previous company regarding your Full and Final settlement.

Whether the LIC pays or not, it is the employer's liability to pay gratuity within thirty days after resignation. But ensure that the company is covered by the POG Act, and you have more than five years of continuous service with this employer.
If you do not receive gratuity, file a claim petition before the controlling authority under the Gratuity Act.
