Hi, I am 4 months pregnant. I am planning to resign when I complete 8 months of pregnancy. I have an ESI card facility. After resigning from my job, am I eligible to claim 12 weeks of salary from ESI or not? Kindly help me, please.

take a leave under panel doctor / dispensary advice, this will entitle you medical benefit plus the wages, which is not available in case of resignation

Hi,

As advised by Sharma, it is better if you continue your job or avail leave for some time. If you resign from your job, then you will not only lose medical benefits for some time but also maternity benefits from ESI.

Madam,

Only a pregnant "employee" can avail maternity benefits. In case you maintain the status of an employee, otherwise NO. If you have resigned and been relieved, you lose the status of an employee and will be out of ESI coverage, hence not entitled to any benefits. Please note. I suggest you follow the advice given by other members above.

As stated by Mr. RDS Yadav, you should continue with your employment; there is no need to resign. You must inform your employer about your pregnancy and the expected date of delivery in writing well in advance so that they can plan for the handover of your duties during your absence. Otherwise, you will not be entitled to maternity benefits. If any issues arise later, you can request leave without pay beyond your entitlement. Only in a worse situation should you resign; otherwise, look for alternative options to care for your child. Make your decision keeping in mind your and your family's better future.

Hi, If you resign your job there after you will not get salary under ESI Act , only can avail benefits for 6 months. Thanks

I am a Social Security Officer of ESI Corporation. For eligibility for maternity benefits, only two conditions need to be fulfilled:

1. On the date of delivery, you have to complete 9 months of service.
2. ESI contributions should be deposited for at least 78 days.

Have you considered resigning after delivery so that the flow of ESI deductions will remain intact until your delivery, ensuring you receive the benefits? Please think carefully before making any decisions.

Your local office will provide you with information on the specific date until which the card will remain valid. Dear Kuneesha,

It will be beneficial if you give your resignation after 30 days of your delivery. You can take leave from the 9th month; however, ensure you submit all required forms (obtained from your IMP doctor) to your ESIC branch office and one copy to your office. Keep a Xerox copy with you.

For ESIC wages, you only require your contribution of 78 days from the previous contribution period.
