Hi,
I joined a software company in march 2014. company asked for a training bond of 2Laks INR. for a period of 2 years.
They have taken an undated cheque for the same.
Now the condition is they are not paying salary from last 3 months on regular basis. currently i did not recived my salary for 2months.
in this case can i break the bond. please advise.

Dear Friend

You are informing that you joined in the service of company in March, 2014 and they are not paying your salary for last 2 months. It means out of 7 months, you got only 5 months salary. So it indicates that your company is either newly start up one or incurring losses for one or the other reason. It is the responsibility of an employer to make payment to his employees as per the provisions of payment of wages act and rules made thereunder. Being a employer if he fails to fulfill his basic responsibility, then you need not worry to break the service agreement

Under these circumstances, you are having following options

1. Give a letter to your employer, asking him to pay your salary in time as per procedure or else you should leave the services of company

2. If they tell it is not possible, then you can give them termination notice for agreement on the ground of failure to pay salary in time

3.Search for another job and give notice of termination later by specifying that due to inability on their part to pay salary in time that you are compelling to quit the job in their company or

4. Ask them to permit you to resign on the above ground and request them to give back your undated cheque

First you should request them to permit you to quit the job by resignation or give termination notice as stated above
