One of my friends has been working in an IT company for the last year, and now he has not been receiving his salary for the past three months. He has spoken with HR many times but has not received any positive responses from their side. Kindly suggest a course of action.

If they didn't get any response, please advise them to contact the local labor enforcement officer of the labor department. Your friend will definitely get a positive result.

Can you share the reason the HR person of that company gave to him? Did your friend submit a written complaint to the HR department about not receiving his salary for the last three months? Please share more information so that we can help you.

I don't think anyone will stay silent when they are not receiving their salary on the monthly payday, especially for three months. There should be a reason for the management to withhold the salary. Please ensure clarity on this matter.

You could ask your friend to follow Mr. Vishal's advice. Whatever the reason, it is very concerning when the organization doesn't pay the salary, especially for 3 months. Please ask him to look for another job immediately, as the job market is good now, and he will surely find a good opening.

In the case of Gayatri's friend, if he is in the worker or supervisor category, then he can approach the local labor enforcement officer of the labor department as per the ID Act. However, if he is in the executive category, he must approach the Civil Court, not the labor court.

Technically you are right However, for most cases, labour officers tend to look into cases of non payment of salary At least they will call or send a notice, that often makes sense
